GENERAL

1.1 Welcome! These Terms and Conditions (hereinafter known as “T&C”) apply to the entire contents of this website and mobile device offering under the domain names www.learnpolishwithweronika.com, (known as the “Website”, “Company” or “WSHH”), and to all contracts entered into by purchasing our courses and to any correspondence between us and you (hereinafter known as the User). The T&C may be updated or amended at any time, and the T&C will include a date of revision at the top of the document.

1.2 Please note that the T&C contains a mandatory arbitration of disputes provision that requires the use of arbitration on an individual basis to resolve disputes in certain circumstances, rather than jury trials or class action lawsuits. The User and the Company each agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a Class, Consolidated or Representative Action. The User and the WSHH both waive any right to a jury trial.

1.3 This legal notice and T&C shall be governed by and construed following the laws of the Republic of Cyprus. Any dispute arising out of or connected with this legal notice shall be subject to the exclusive jurisdiction of the Cypriot courts under Cypriot law.

You may be subject to additional terms and conditions that will apply when you use or purchase the Company’s services and products.

1.5 The failure of WSHH to exercise or enforce any right or provision of the T&C shall not constitute a waiver of such right or provision.

4.4.1. Any User conduct deemed in breach of the terms and conditions, WSHH Community guidelines or general appropriateness may result in a ban from the WSHH Community or other parts of the Website.

4.4.2. User conduct warranting a ban from the WSHH Community or other parts of the Website is solely at the discretion of WSHH.

4.4.3. A ban from WSHH due to behavioural breaches represents a breach of the terms and conditions of this contract and voids any applicable refunds. Users may still be able to access all other elements of the courses that they have purchased, within the stated duration.

IF YOU PAID FOR CONTENT AND COURSES

5.1. Within the course section of the Website, the User will find an overview of the paid courses that can be bought by the User. By purchasing a course, the user receives access to learning content and courses for either a specified duration and within the framework of the respective course for the entire contract lifetime and in accordance with meeting the payments of a subscription licence.

5.1.1 Lifetime access to the course means that once full payment has been completed, you will retain access to the course materials (videos, PDFs, and exercises in their non-supported form) for as long as the course is offered by WSHH.

• If at any point the platform or course is retired, students will receive advance notice and the opportunity to download or transfer materials where possible.
• Lifetime access does not include tutor support or participation in student groups beyond the agreed support period.

5.2. Any paid services, insofar as prices are quoted on the Website, are understood to include any applicable statutory VAT, whether added additionally at checkout or for the VAT to be included in the total price. An Individual student may be VAT exempt if they reside outside the European Union or have a right to be VAT exempt as a business individual. If the student is a business client, they may provide a valid VAT number at checkout.

5.3. You may not subscribe to a payment schedule if you are under 18 years of age or prohibited from using our service under the laws of the country in which you are resident.

5.4. The billing type, price and contract lifetime are each listed as part of the ordering process and are fully summarised before completion of the order.

5.5. Course access is provided upon payment and the start date of the contract term being the date the course is purchased.

5.6. Subscription contracts (or installments) have a start date of the date of purchase and either a set duration or an unlimited duration with a specified, periodical payment date.

5.7. If a student follows an automated Payment Schedule with installments like for example a 3-installment payment plan, with each installment set at for example $46, the payments will occur on the same day every month based on the date of your initial enrollment.

Due Dates:

– First installment: Upon initial enrollment

– Second installment: One month after the initial payment

– Third installment: Two months after the initial payment

No further installments will be charged according to the agreement.

5.7.1 Access to the Course:

If the first installment is paid upon enrollment, full access to the course will be granted. If the second installment is not paid by its due date, access will be temporarily suspended.

5.7.2. Grace Period and Installments

Students have a grace period of up to 3 months to complete payment of the second and third installments if a payment fails on the scheduled due date.

• If a payment fails, you will automatically receive an email from us. This email will include instructions on how to update your payment details (if they have changed) or how to contact us to settle the payment.
• If the second installment is not paid within 30 days of its due date, and you do not contact us within that time, it constitutes a breach of these Terms & Conditions. In such cases, the split payment plan will be cancelled, the contract terminated, and your access limited to the initial 30-day period granted between the first and second installment.
• If you contact us within the 30-day period and notify us of financial difficulties, we may extend a grace period of up to 3 months to allow additional time to complete your payment.

Example:

A student signs up for a course on 16/01 and agrees to pay $87 on 16/01, 16/02, and 16/03 in order to maintain lifetime access.

• The initial payment on 16/01 is successful, so the student receives 30 days of access.
• On 16/02, the payment fails due to expired card details or insufficient funds. Access is temporarily restricted.
• The student receives an automatic email notifying them of the failed payment and is given 30 days to update their payment details or contact us.
• If there is no payment and no contact by 16/03, the student permanently loses access, in line with these Terms & Conditions.
• If the student contacts us within the 30 days to explain financial difficulties, we may extend the grace period for up to 3 months.

5.7.2.1 Loss of Access:

If the second and third installments are not received within the 3-month period, access to the course will be suspended. Non-payment without any communication will result in the unenrollment and cancellation of the subscription.

5.7.2.2 Re-enrollment:

If students wish to enrol again in the future, they will need to do so as if they were enrolling for the first time.

5.7.2.3 Communication:

If difficulties arise or delays in payments are foreseen, students should contact LearnPolishWithWeronika.com at help@learnpolishwithweronika.com as soon as possible.

The company appreciates your understanding and cooperation in adhering to this installment payment policy. The company’s goal is to provide quality education and support for all students.

5.8. Access to LearnPolishwithWeronika.com courses, communities, or other elements of the Website is provided for the duration of the course purchased.

For lifetime purchases, “lifetime access” means access to the purchased course materials (videos, PDFs, and non-supported exercises) for as long as the course is made available by LearnPolishwithWeronika.com.

• Community access is provided for the agreed support period only (e.g., 6 months), unless otherwise explicitly stated.
• If a platform or community is discontinued (e.g., Telegram or Facebook), access to that group will end, and no replacement community is guaranteed.

5.9. By selecting a subscription-based course, the User agrees to periodic charging through the selected payment method at the selected time periods (e.g. monthly subscription has monthly charge periods).

5.10. Subscription Plans and Split Payments

The subscription plan to our Services consists of an initial charge followed by recurring charges (e.g., monthly installments) as agreed to by you at checkout and explained in clause 5.7.2. By entering into this Agreement, you acknowledge and accept responsibility for all recurring charges until the payment plan is completed or properly cancelled.

• If you enrolled in a split payment plan (e.g., 3 installments) and wish not to continue, you must notify us directly at help@learnpolishwithweronika.com to request cancellation.
• Such cancellation requests must be made before the next scheduled installment is due. Failure to notify us will result in continued charges in line with the agreed payment plan.

To update your payment method, log into your PayPal/account and manage your automatic subscription under the “Update my info” tab at https://checkout.learnpolishwithweronika.com/updateinfo/ or use the link provided at the bottom of your purchase invoice.

5.12. Updating Payment Details

For security reasons, WSHH cannot view, access, or input your card details on your behalf. Your payment information is confidential and can only be updated by you directly.

• If you signed up using a credit or debit card (not via PayPal), you must update your subscription details yourself through our secure payment portal, available at the link provided in your purchase invoice or at https://checkout.learnpolishwithweronika.com/updateinfo/.
• If you subscribed using PayPal, any updates to your payment method must be made directly within your PayPal account.

5.13. Single Payments/One-off Payments provide access to single or multiple courses for the duration outlined in the purchase. This may be X amount of months or lifetime. At the point of purchase, your contract term will initiate and after the stated duration, your contract will end and your access to WSHH will expire.

5.14. Lifetime packages provide access to the stated courses for the duration of their availability. Lifetime refers explicitly to the duration of the product(s) included in the Lifetime package, at the point of purchase. If one or more of the products expire or are closed in any way WSHH is not required to replace the product with a like-for-like product. Access to any equivalent or replacement product is explicitly at the discretion of WSHH. Access to the WSHH Community under the lifetime package is for the duration of the availability of the WSHH Community. Any student with a Lifetime package providing access to the WSHH Community can invalidate their access to the community under these terms by acting outside the contractual agreement, guidelines of the WSHH Community or be otherwise in breach of behavioural standards as defined by WSHH. Any decision regarding behavioural appropriateness/breaches is explicitly, solely and finally at the discretion of WSHH.

5.15. Submitting Recordings and Tutor Feedback (Support / VIP Packages)

If you purchase a course that includes voice recording or tutor feedback (the Support / VIP package), please note the following conditions:

• Submission deadline: All recordings or assignments must be submitted before the product duration ends. Late or incomplete submissions are non-refundable.
• Recording format & quality: Audio recordings must follow the format outlined in the course and be of sufficient quality to be reviewed. If the quality is poor, feedback will still be provided, but it may be limited.
• Additional recordings: If new or replacement recordings are needed because the originals were unusable, you will need to purchase a separate assessment.
• Feedback time: Feedback on submitted recordings is usually given within 7 days. We will do our best to meet this timeframe, but it is not a guaranteed contractual deadline.
• Refund policy: Once recordings are submitted for assessment, the cost of the assessment is non-refundable.

RENEWAL, CANCELLATION AND TERMINATION OF CONTRACTS

6.1. User cancellation and termination rights are carried out in line with Consumer Contract Regulations.

6.2. 14-Day Money Back Guarantee

6.2.2. Users who purchased directly through learnpolishwithweronika.com may cancel any purchase of a course within 14 days, and receive a full refund.

6.3. Some products are non-refundable, such as digital downloads, level tests, or other digital products. If a digital product is non-refundable, that is always stated on the page. No refunds are granted due to the non-returnable nature of digital products once they’re downloaded. This is in accordance with the EU Law "Guarantees and returns". More information https://europa.eu/youreurope/citizens/consumers/shopping/guarantees-returns/index_en.htm

6.4. If you purchase a course or a product on the Website, that has the 14-day money-back guarantee, you have exactly 14 days from the date of purchase to request a refund when applicable. For example, if you purchased a course on April 1st at 9 P.M., you can request a full refund until the 15th of April by 9 P.M. We must receive your email by that time.

To initiate a refund, please email us at help@learnpolishwithweronika.com within the specified 14-day period.

Refunds will only be processed if you have completed no more than 10% of the course or product content and have not downloaded any summaries or PDFs. Completing more than this threshold disqualifies you from the money-back guarantee. You are also ineligible for a refund if you submit any exercises that require manual feedback from the tutor, such as voice recordings for pronunciation checks or written assignments.

6.4.2. If your payment was made in installments (e.g., a subscription), and you request a refund after the 14-day period, we will cancel any remaining installments, but we can’t refund you.

Example: You purchased the course in 3 installments on April 1st but decided you want a refund on April 17th. Only the remaining 2 installments will be canceled. A refund of the first installment won’t be possible, since you exceeded the 14-day time period. Please note that refund requests made after the 14-day period or for courses where more than 10% of the content has been completed will not be honored.

6.4.3. Refund Policy and Restrictions on Subsequent Purchases

Each student is eligible to request a refund only once, regardless of how many courses or products they plan to purchase in the future. If a student requests a refund within 14 days of their first purchase, this will be granted as long as they have not completed more than 10% of the course and have not downloaded any materials. In this case, WSHH Services Ltd will issue a full refund, including card or PayPal fees and transfer fees, at the company’s expense.

However, if the student decides to repurchase the same course or part of it after receiving a refund and later requests a second refund, they will no longer qualify for a refund. This is considered abuse of the policy.

Courses are digital products, which by law are non-refundable, and the company offers a 14-day money-back guarantee only for the first purchase. If a student seeks a second refund for a repurchased course, WSHH Services Ltd will consider the refund request invalid and will not process any further refunds. The student will be blocked from making future purchases.

This policy is in place to prevent abuse and to comply with legal requirements, including those concerning money laundering.

6.4.4.

As mentioned in the point 6.3 Digital downloads and digital products sold on our website fall under the online digital content category in EU regulations, which by law classify as non-refundable once downloaded or streamed, and by law, you lose your right of withdrawal by starting the performance. However, as an act of courtesy, we offer this 14-day money-back guarantee to ensure that all our students have enough time to assess the course content before making a commitment. This gesture comes with the risk of students downloading all the materials and then requesting a refund, but we believe it's essential to prioritize your satisfaction and confidence in the course. For more information about EU digital downloads refunds, please visit: EU Digital Downloads Refunds. We, as a company registered in the European Union, won't be able to issue any refunds post the 14-day Money-Back Guarantee, under no circumstance. It's your responsibility to check the course content within the 14-day timeframe.

6.4.5.

Promotion and Refund Policy

During the Christmas promotion, clients who purchase the A1 (Part 1) or A1 (Part 1 & 2) course with support will receive the A1+ E-Book "W jedną stronę do Wrocławia" for free. If suspicious behaviour is detected—such as purchasing a course, downloading the e-book, and initiating a refund shortly thereafter—€10.99 (or the equivalent in another currency) will be deducted from the refund as the e-book's value.

6.5.

Refund Policy and Student Responsibilities

Refunds will only be processed if you have completed no more than 10% of the course or product content and have not downloaded any summaries or PDFs. Completion beyond this threshold disqualifies you from the money-back guarantee. You are also ineligible for a refund if you submit any exercises that require manual feedback from the tutor, such as voice recordings for pronunciation checks or written assignments.

By enrolling in the course and ticking the Terms & Conditions box upon purchase, you acknowledge and accept all of these terms.

If you purchase the version of the course that includes 6 months of tutor support, it is your responsibility to complete and submit all assignments requiring manual feedback within that six-month window. If you wish to extend access to tutor-checked exercises beyond that period, you may do so by purchasing an additional subscription. Otherwise, after six months, your access will be automatically shifted to the lifetime version of the course, which does not include tutor-reviewed assignments.

Please note: it is not our responsibility whether you opened the course, had time, or were able to start during the support period. Our tutors are paid based on your purchase date, and your six-month support begins from that moment. We do not grant free extensions for tutor-checked exercises under any circumstances.

Responsibility to Create an Account and Refund Timeframe

It is the student’s responsibility to create an account and access the course materials within 14 days of purchase to determine whether the course meets their expectations. Refund requests submitted after this 14-day period will not be processed, as the opportunity to review the course content will have expired.

6.6.

Payment Methods and Authorization

By adding a payment method to your account, you authorize WSHH SERVICES LTD to charge that payment method for the full amount due for any services, products, or subscriptions you have selected. You agree that if your primary payment method is declined or cannot be charged for any reason, WSHH SERVICES LTD may charge any other payment method associated with your account, including any additional cards you have added.

You understand and agree that it is your responsibility to ensure that valid payment methods are available in your account and that you maintain accurate billing information (~clause 5.7.2). WSHH Services LTD will notify you of any failed payment attempts, and you agree that WSHH Services LTD may take appropriate actions to collect due amounts, including attempting to charge other available payment methods.

If all payment methods associated with your account fail, your account may be suspended or terminated at our discretion until the outstanding balance is resolved.

6.7.

Promotions and Price Adjustments

From time to time, we may offer discounts or promotional pricing on our digital courses. These promotions are valid only during the specified promotional period and cannot be applied retroactively to purchases made before or after that time.

Requests for partial refunds or price adjustments due to later promotions or discounts will not be accepted.

Once a purchase has been completed and an invoice issued, the price is considered final and binding. Under EU invoicing and accounting regulations, issued invoices cannot be arbitrarily modified to reflect later price changes.

We encourage customers to subscribe to our newsletter or follow our official communication channels to stay informed about upcoming offers and discounts.

6.8.

B2C Transactions and Refund Eligibility

Please note that refunds are only applicable to B2C (business-to-consumer) transactions. If the purchase was made under B2B (business-to-business) terms, it is non-refundable. B2B transactions are not covered under the 14-day money-back guarantee or any other consumer protection regulations. By purchasing a product or service under B2B terms, you acknowledge that no refund will be issued.

15.4. Fair Support Communication Usage

By using the support communication channels, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the support channels.

15.4.1 Scope of Support

Support is provided only through the designated communication channels, which may include email and/or Telegram groups (for students enrolled in the VIP program), directly with tutors and their assistants. Use of these channels must remain respectful, relevant to the course, and in accordance with these Terms.

15.4.2 Availability

We aim to provide support during designated hours of operation (Monday to Friday, CET time zone). However, availability may be affected by factors outside of our control, including but not limited to technical issues, outages, or maintenance by third-party providers (such as email or Telegram). We do not guarantee uninterrupted or error-free access to these support channels.

15.4.3 Response Times

We make reasonable efforts to respond to inquiries in a timely manner. Actual response times may vary depending on the volume of inquiries, the complexity of the questions, or staff availability. Response timeframes are not guaranteed and shall not be considered binding contractual obligations.

15.4.4 Limitation of Liability

Users of the support chat feature are expected to provide accurate and relevant information about their inquiries to enable our support team to assist effectively.

Users must conduct themselves in a respectful and professional manner when engaging with our support team. Any form of harassment, use of offensive language, or behavior that violates our general Terms of Use will not be tolerated and may result in immediate termination of support access.

The support chat support feature is provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, regarding the availability, quality, or accuracy of the support provided through this feature.

In no event shall we be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the use of the chat support feature, even if we have been advised of the possibility of such damages.

15.4.5 Limited Access Version (Without Support):

Customers have the option to purchase courses without teacher support. This version includes access to video lessons, PDFs, and embedded exercises only. It explicitly excludes any form of teacher's support, including but not limited to: comments, feedback, email explanations of Polish language concepts, or answers to questions about course content. Communication with us is strictly limited to technical issues or payment-related inquiries. By choosing this option, you acknowledge and accept these limitations.

15.5. Self-Study and Direct Communication Support Guidelines

We strongly encourage all students to first go through the recorded course materials provided as part of their lifetime access to the course. These materials are designed to provide comprehensive learning resources and address common questions and challenges.

15.5.1 Appropriate Use of Tutor Support

Contacting tutors should only be done after students have made reasonable efforts to find answers or solutions within the course materials. The purpose of tutor communication is to provide guidance, clarification, and assistance specifically related to the course content.

The support chat feature is not intended for general conversation, unrelated discussions, or for requesting additional lessons beyond the scope of the purchased course. Misuse of the support chat for irrelevant inquiries or attempts to obtain free lessons may result in removal from the course.

For conversation or community discussions, students are encouraged to use the designated Facebook or Telegram groups.

15.5.2 It is essential for students to understand that the tutor's support feature should be used responsibly and respectfully. The number of questions per student should not exceed 30 for the “From Zero to Hero” course and 60 for the “From Hero to Mastery” course. This limit ensures a fair distribution of support resources among all students. In case of any abusive or disruptive behaviour aimed at misusing the support chat support feature or violating the Terms and Conditions, we reserve the right to terminate the agreement immediately.

15.5.3 By using the chat support feature, you acknowledge that you have read, understood, and agree to abide by these Self-Study and Direct Communication Support Guidelines. If you have any questions or concerns regarding these Terms, please contact us at help@learnpolishwithweronika.com

15.5.4 Use of Student Voice Recordings

By participating in our support program and submitting voice recordings (e.g. via voice notes), you grant us permission to use only your voice (without your name, image, or any identifying details) in a positive and respectful manner for promotional purposes, such as social media videos and other marketing content. These materials may be used to showcase and recommend this style of learning to prospective students. We take your privacy seriously. Only the audio (voice) is ever published, and it is always used in a way that protects your identity.

If we feature your voice in a published video, and you would prefer for it not to be used, please contact us at help@learnpolishwithweronika.com, and we will promptly remove the content.
